This time, she’s discussing the precarious status of Hamza’s green card battle. And yes, it will likely be a fight.
In fact, Martinez points out that Hamza’s green card status will be an “uphill battle”.
He and Memphis were divorced in late October 2022. It’s a very short marriage, and an even shorter time together in America.

“So if she already has her green card but got it within two years of the wedding, it’s a conditional green card,” Martinez explained.
“I mean it’s conditional on her being married,” he said.
“At the two-year mark, they will need to apply to have those conditions removed,” Martinez continued. “And request that the requirement for the signatures of the spouses be waived.”
This may be a bit of a challenge considering how brief their marriage was. And they lived separately in different cities for months before their divorce was finalized.
Hamza must prove to immigration officials that his marriage to Memphis was natural and valid. and that his divorce from her was just as sincere.
Martinez summarized that he had to make it clear that he married for love and “not for a green card.”
Getting that exemption, and meeting that burden of proof, is rarely easy. And the optics of Hamza’s previous marriage won’t help.
“Their marriage looks fraudulent,” Martinez characterized candidly.
“If they didn’t know each other long before getting married, they get divorced sooner,” she explained. “It’s going to be an uphill battle to keep his green card.”
After months of bitter separation, Memphis and Hamza finalized their divorce on October 28, 2022. We do not know the exact date of their marriage, but they were likely married for a year before their separation.
Meanwhile, Martinez said that if Hamza was not exempted from the marriage requirement, he “could lose his green card.”
This could lead to immigration services placing him in removal proceedings. However, she said, this is not possible unless he commits a crime.
